Recent Personal Injury and Car Accident News and Cases related to Hawaii
The Georgia Supreme Court has recently found that defense attorneys are barred by HIPAA from making ex parte contacts with a plaintiff's prior treating physician, Moreland v. Austin, Georgia Supreme Court No. S08G0498 (Nov. 3, 2008). In spite of Georgia state law which permitted such contacts, the Georgia high court found that HIPAA's notice and consent requirements preempted state law. Hawaii's courts will likely provide similar protection for the Hawaii litigant.
