Congressional grants of tort immunity obtained by big business through political contributions and lobbying are finally hitting some limits. In 2005 the rental car industry managed to get immunity for harm caused by their vehicles, known as the "Graves Amendment", passed as an amendment snuck into a 900-page transportation appropriations bill without review from the relevant congressional committees. On September 14, 2007 the U.S. District Court for the Southern District of Florida declared the Graves Amendment providing tort immunity to the rental car industry to be unconstitutional. The Court reasoned that federal grants of immunity for businesses traditionally regulated at the state level constitute an overreaching of Congress' power under the Commerce Clause. The
deadline for filing most Outer Island claims in
court in Hawaii is generally the same as the deadlines
for filing the same claims in Honolulu. (See the page for the particular
type of claim involved in the menu bar on the left.)
Once again, it should be specifically noted that claims
against the various Counties must generally be filed
with the appropriate agency
within six (6) months of the date of the accident.
You must file your claims in
court prior to the expiration of such deadlines, or your
claims may be lost—regardless of their merit.

order to maintain prompt contact- every
effort is made to respond to communications the day
that they occur. For our Outer Island clients with

frequently advanced the costs of travel for depositions and
client conferences here in Honolulu. Frequently, an attorney
will also visit you on your home island to travel with you

the claim with the applicable insurance companies often require
high level negotiations with management of the insurer.
The
adjuster generally does not have authority to commit the insurer
to a reasonable value on most settlements. Hence, the real
nuts and bolts negotiation on most insurance settlements takes
place right here in Honolulu- with your attorney and often the insurance
adjuster both trying to get the insurer's management to come
through with a reasonable value to settle a case. In short, it is
often an advantage to have a Honolulu attorney when settlement
negotiations are taking place.
