Recent Personal Injury and Car Accident News and Cases related to Hawaii

On June 29, 2015, the Hawaii Supreme Court rendered its decision in the case of St. Paul Fire and Marine Ins. Co. v. Liberty Mutual Insurance, Hi. Sup. Ct. Case No SCCQ-14-0000727 (June 29, 2015). This case arose out of a wrongful death personal injury case handled by this office which resulted in a $4.1 million verdict in favor of our clients - even though Liberty Mutual, the primary liability insurer, never offered anything even close to its policy limits of $1 million. St. Paul - who had to pay our clients everything recovered in excess of the initial $1 million - claimed that Liberty Mutual committed bad faith towards it by failing to settle within its $1 million policy limits. The Hawaii Supreme Court agreed and found that an excess insurer has claims for bad faith against a primary insurer.

You must file your claims in court prior to the expiration of such deadlines, or your claims may be lost—regardless of their merit. To be wise it is recommended that you immediately contact an attorney after an accident giving rise to injuries occurs- please do not hesitate to :

Maui, Kauai, Hawaii and Outer Island Claim Information

Over the years Hawaii Personal Injury Attorney William H. Lawson has vigorously and competently represented clients for matters on all islands in the State of Hawaii while maintaining a high degree of contact and communication with our clients by phone, by email and by regular mail. Hawaii Personal Injury Attorney - Maui and Kauai In order to maintain prompt contact- every effort is made to respond to communications the day that they occur. For our Outer Island clients with Maui, Kauai, Hawaii and Outer Island claims- we have frequently advanced the costs of travel for depositions and client conferences here in Honolulu. Frequently, an attorney will also visit you on your home island to travel with you to the accident scene and/or to see and record the impact of the injuries on your life.

Handling an Outer Island injury claim from a main office in Honolulu does not pose any significant challenges to a timely and successful prosecution of the claim. Regardless of which island an accident takes place on, the investigative workup of the case usually will be done by local investigators hired by this office. Photos, videos, statements and the like will be gathered by a local investigative firm familiar with the accident scene and the tendencies of the people in that area. Once that is completed, there may be expert witness workup of the facts and circumstances of the case. Although there are competent expert witnesses in many fields on the outer islands, for the most part the experienced and highly qualified experts are located on the island of Oahu. Hence, there is generally a slight time and costs savings when working with an expert witness on an Outer Island case if the attorney is located in Honolulu.

Once the proper workup has been done, efforts to settle the claim with the applicable insurance companies often require high level negotiations with management of the insurer. Hawaii Personal Injury Attorney - Maui & Kauai The adjuster generally does not have authority to commit the insurer to a reasonable value on most settlements. Hence, the real nuts and bolts negotiation on most insurance settlements takes place right here in Honolulu- with your attorney and often the insurance adjuster both trying to get the insurer's management to come through with a reasonable value to settle a case. In short, it is often an advantage to have a Honolulu attorney when settlement negotiations are taking place.

Should the matter proceed to trial, our office has successfully handled personal injury arbitrations and trials for Maui, Kauai, Hawaii and other Outer Island claims. If we need to go to trial on an outer island, Hawaii Personal Injury Attorney William H. Lawson has done so and is prepared to do so again. Alternatively, should it be necessary, Hawaii Personal Injury Attorney Lawson has also co-counseled with attorneys on Maui, Kauai, Hawaii and other Outer Islands and is prepared to do so again in an appropriate situation.
